Summary of Question 5
Sections 3 to 7 of Chapter 44B of the General Laws of Massachusetts, also known as the Community Preservation Act, establish a dedicated funding source to acquire, create and preserve open space, acquire, preserve, rehabilitate and restore historic resources, acquire, create and preserve land for recreational use, acquire create, preserve and support community housing; and rehabilitate or restore open space, land for recreational use and community housing acquired or created as provided in Section 5 of the Act. In Middleborough, the Community Preservation Act will be funded by an additional surcharge of 1% on the annual tax levy on the real property to be assessed beginning in fiscal year 2011, and by funds provided by the state. Property owned and occupied as a domicile by any person who qualifies for low income housing or low or moderate income senior housing in the Town, and $100,000 of the value of each taxable parcel of residential real property will be exempt from the surcharge. A Community Preservation Committee will be established by-law following acceptance of the Act and will make recommendations to Town Meeting on the use of the funds.
